SCHOOL DIVISION LEGAL STATUS
The official
name of the School Division is the
Portage la Prairie School Division.
The legal basis of education in the
Portage la Prairie School Division is
vested in the will of the people as expressed in the statutes of the Province of
Manitoba, the statutes pertaining to education, the court interpretation of the
validity of those laws, and the powers implied in them.
Following
the January 14th, 1959 School Divisions Boundaries Commission
proposal for the establishment of a school Division to be styled and known as
The Portage la Prairie School Division
No. 24” (See AA-E1), such a division was established by an ORDER OF THE
MINISTER, dated April 1st, 1959, (See AA-E2).
It was one of the thirty-seven Manitoba School Divisions initially formed
in April of 1959, to have jurisdiction over secondary education, while the small
school districts were to retain responsibility for elementary education.
The consolidation process was completed
on the 11th day of March, 1967, with an ORDER OF THE MINISTER
declaring The Portage la Prairie School
Division No. 24 a school division within section 443 of
The Public Schools Act, in effect
giving the Division jurisdiction over elementary and secondary education (See
AA-E3).
The
1993 School Division and Districts
Regulation (M.R. 109/93) confirmed the status of the Division under Section
19 of Schedule 1, as the “Plan of the Portage la Prairie School Division as
shown on the Director of Surveys Plan 20236, Director of Surveys Order dated
November 20, 2002, on record in the office of the Department of Education and
Youth in the City of Winnipeg.”
On
July 17th, 2002, the deletion of numbers from school division names
received royal assent, and our Division became known as
The Portage la Prairie School Division.
