Provincial legislation allows The Portage la Prairie School Division and CUPE Local 2085 to enter into an agreement regarding the exemption of overtime.

The utilization of the overtime exemption allows the Division to allocate the extra curricular driving time to drivers according to the plan outlined in EDA-R.

It is mutually understood between the Division and CUPE that:

1. The only hours that are exempt from overtime are those accumulated as a result of regular route driving time and extra curricular driving time.

2. Driving hours accumulated as a result of an emergency or unusual situation are not exempt.

3. Driving time referred to in #1 will be paid at the regular rate for all hours, including hours in excess of 8 hours per day and hours in excess of 40 hours per week.
